General Terms

These Terms of Service govern your access to and use of services provided by ElderHubLegal. By using our services or creating an account, you agree to comply with these terms. ElderHubLegal provides professional legal advisory services; use of the services indicates acceptance of the terms and the relevant privacy practices.

Eligibility

Access to ElderHubLegal services requires that you have the legal capacity to enter into an agreement and use the services in accordance with these terms. You must ensure that your use complies with any local laws that apply to you.

You must be at least 18 years old to use ElderHubLegal services. If you are acting on behalf of an organization, you represent you have authority to bind that organization to these terms.

You agree to use the services only for lawful purposes and not to engage in any activity that would constitute the unauthorized practice of law, fraud, harassment, or other unlawful conduct.

Services are intended for users in Malaysia and may be subject to limitations in other jurisdictions. It is your responsibility to ensure that access from your location is lawful and that any professional advice provided is appropriate for your jurisdiction.

Account

Certain services require registration and an account. You are responsible for maintaining accurate account information and for all activity conducted through your account. ElderHubLegal is not responsible for losses resulting from unauthorized use of your credentials.

You must provide current, complete and accurate information when creating or updating an account. Failure to do so may result in suspension or termination of services.

Protect your login credentials and enable any available security features such as multi-factor authentication. Notify ElderHubLegal promptly if you suspect your account has been compromised.

Accounts are personal and non-transferable. Transferring access or credentials to another person without prior written consent is prohibited.

If you believe your account has been accessed without authorization, contact ElderHubLegal immediately using the contact details provided. Prompt notification helps mitigate risk and allows us to contribute.

ElderHubLegal may suspend or restrict access to accounts for suspected breaches of these terms, security concerns, non-payment or as required by law. We will inform you of the reason where feasible.

Services

ElderHubLegal provides senior legal advisory services, including legal guidance, document review, planning and referrals to qualified practitioners as appropriate. Advice provided is based on the information you supply and is intended to assist in your decision-making. Outcomes depend on many factors and results cannot be assured.

We may modify, add or discontinue services, features or tools at our discretion. Changes will be communicated through our website or direct communication where appropriate.

Service availability may be affected by operational constraints, third-party dependencies, or maintenance activities. ElderHubLegal uses reasonable efforts to maintain availability but cannot ensure uninterrupted access at all times.

User Conduct Rules

When using ElderHubLegal services you must follow these conduct rules to maintain a professional and lawful environment.

  • Use the services only for lawful purposes and provide truthful information.
  • Respect the rights and dignity of our staff, advisors and other users; abusive or harassing conduct is prohibited.
  • Do not attempt to disrupt, interfere with or reverse engineer the services or infrastructure.
  • Do not submit malware, phishing content or harmful code.
  • Do not impersonate other individuals or provide false credentials.
  • Comply with applicable professional and ethical rules when seeking legal advice.
  • Respect intellectual property rights and do not upload content that infringes third-party rights.

User Content

User content includes any information, documents or materials you upload or provide in connection with services. You are responsible for the content you submit and for ensuring it does not violate these terms or applicable laws.

You retain ownership of your user content. By submitting content, you represent that you have the necessary rights to provide it to ElderHubLegal for the purposes for which it is submitted.

By providing user content you grant ElderHubLegal a non-exclusive, revocable license to use, store, reproduce and process the content solely to provide the requested services and to comply with legal obligations.

You are responsible for the accuracy, legality and appropriateness of your content. ElderHubLegal is not responsible for user-provided content and may remove content that violates these terms or poses a legal risk.

ElderHubLegal may remove or restrict access to user content that breaches these terms, infringes rights, or is unlawful. Requests for content removal will be assessed and actioned in accordance with applicable law.

Intellectual Property

All intellectual property rights in the ElderHubLegal website, branding, content, software and service materials are owned or licensed by ElderHubLegal. Users must not copy, modify or redistribute proprietary materials without prior written consent.

  • Do not reproduce or distribute site content without permission.
  • Do not attempt to reverse engineer or extract source code from our software.
  • Do not remove copyright, activity or other proprietary notices from materials.

Paid Services

Certain advisory services are provided on a paid basis. Fees, billing arrangements and the scope of paid services will be set out in a statement of work, engagement letter or subscription terms as applicable.

Pricing is provided in quotes, on invoices or via the client portal. Fees reflect the scope of work, complexity and expertise required. All pricing is subject to the terms of the relevant engagement agreement.

Payments must be made in the currency specified on the invoice and by the payment methods we accept. Timely payment is required to continue receiving paid services. Outstanding balances may incur interest or collection actions in accordance with applicable law.

Subscription services, where offered, will include details of billing cycles, renewal terms and cancellation options in the subscription agreement. Users are responsible for managing subscription settings and renewals.

Refunds are considered in line with the scope of work and the extent of services performed. Where work has been undertaken, refunds may be reduced to account for services already rendered. Refund determinations are made on a case-by-case basis.

Clients may cancel paid services in accordance with the notice terms in their engagement or subscription agreement. Cancellation may not relieve outstanding payment obligations for work already completed.

Clients are responsible for any taxes, duties or levies applicable to the services provided, unless otherwise stated. ElderHubLegal may charge applicable taxes as required by law.

ElderHubLegal may adjust pricing for services with notice. Existing clients will be notified in accordance with the terms of their engagement or subscription agreement.

Failure to pay fees may result in suspension of services, referral to collections, or termination of the engagement. ElderHubLegal will provide notice and an opportunity to cure where practicable.

Professional Disclaimer

Information and advice provided by ElderHubLegal are general in nature and based on the details you supply. They do not create an ongoing lawyer-client relationship unless expressly confirmed in writing. For matters requiring formal representation or court proceedings, a separate engagement may be necessary with qualified counsel.

Limitation of Liability

To the extent permitted by applicable law, ElderHubLegal's liability for direct damages arising from the provision of services is limited to the amounts paid by the client for the specific services during the twelve months preceding the event giving rise to liability. ElderHubLegal is not liable for indirect, incidental, special or consequential damages, except as required by law.

Third-Party Providers

ElderHubLegal may engage third-party service providers (for example technology, research or specialist advisers) to assist in delivering services. We select providers based on competence and reliability and require them to adhere to confidentiality and data protection standards.

Termination

Either party may terminate an engagement as set out in the applicable agreement. ElderHubLegal may also suspend or terminate access to services for breach of these terms or non-payment. Termination does not relieve either party of obligations accrued prior to termination.

Upon termination, we will cease provision of services and return or securely destroy client materials as directed, subject to retention obligations and outstanding fees. Some provisions of these terms will survive termination, including confidentiality and limitation clauses.

Privacy

Our handling of personal data is described in the ElderHubLegal Privacy Policy. By using our services you consent to the collection and use of personal data as set out in that policy.

Communications

By engaging with ElderHubLegal you agree to receive communications electronically, including emails and portal messages. You may opt out of non-essential communications as described in our privacy notices, but essential service communications may still be delivered electronically.

Changes to Terms

ElderHubLegal may update these terms from time to time to reflect legal, regulatory or operational changes. Significant updates will be communicated where required and will take effect as published.

Governing Law

These terms are governed by and construed in accordance with the laws of Malaysia. Any claims arising from or related to these terms will be subject to the jurisdiction of the courts of Sabah, Malaysia, unless otherwise agreed in writing.

Dispute Resolution

If a dispute arises, parties should attempt to resolve it amicably through good-faith discussions. If unresolved, the dispute may be brought before the courts in Sabah, Malaysia in accordance with the governing law provision.
